The Minister of Internal Affairs, Marcel Vela, issued a military ordinance on Saturday night, prohibiting the movement on the public domain of groups larger than 3 persons. At the same time, traffic recommendations are introduced during the day and especially at night. It also suspends the commercial activity of several types of commercial activities, such as dental offices or mall stores, except those that sell food, veterinary, pharmaceutical or cleaning services. The measures take effect from Sunday, from 22:00.
The military ordinance has 11 articles and provides:
Article 1. -
(1) The activity in the dental medicine offices is temporarily suspended.
(2) By emergency, emergency dental interventions are allowed.
(3) The measure shall be applied from March 22, 2020, at 22:00, the time of Romania.
Article 2. -
(1) The retail activities, products and services shall be temporarily suspended in the commercial centers where several economic operators operate, except for the sale of food, veterinary or pharmaceutical products and of cleaning services.
(2) A commercial center is understood as "the medium or large surface sales structure in which retail activities of products, market services and public food, using a common infrastructure and appropriate utilities", are carried out. regulated in the annex to Law no. 296/2004 regarding the Consumer Code, republished, with subsequent amendments and completions.
(3) The measure shall be applied from March 22, 2020, at 22:00, the time of Romania.
Article 3. -
(1) The movement of persons outside the home / household shall be carried out only in compliance with the general measures to prevent the spread of COVID-19 and to avoid the formation of any group of persons.
(2) By forming a group of persons it is meant to join a greater number of 3 persons who do not live together.
Article 4. -
Between 06.00 and 22.00, it is recommended that the movement of persons outside the home / household should be carried out only for the following reasons:
a) travel in professional interest, including travel between home / household and the place / places of professional activity, when professional activity is essential and cannot be postponed or carried out remotely;
b) travel for the provision of goods that cover the basic needs of the persons and the pets / pets, as well as goods necessary for the professional activity;
c) travel for healthcare that cannot be postponed or performed remotely;
d) displacement for justified reasons, such as caring / accompanying the child, assistance of elderly, sick or disabled persons or death of a family member;
e) short trips, near the home / household, related to the individual physical activity of the people and the needs of the pets / pets.
Article 5. -
(1) During the hours 22.00 - 06.00, the movement of persons outside the home / household is allowed only for the reasons provided in art. 4.
(2) In order to verify the reason for the move in the professional interest, the persons are obliged to present, at the request of the personnel of the authorized authorities, the service card, the certificate issued by the employer or a declaration on their own responsibility.
(3) In order to verify the reason for the trip in the personal interest, the persons are obliged to submit, at the request of the personnel of the authorized authorities, a declaration on their own responsibility, completed in advance.
(4) The declaration on its own responsibility must include name and surname, date of birth, address of place of residence / household / place of professional activity, reason for travel, date of completion and signature.
(5) The measure shall be applied from March 23, 2020, at 22:00, the time of Romania.
Article 6. -
(1) It is forbidden to enter the territory of Romania, through the crossing points of the state border, of foreign citizens and stateless persons, unless they transit through the territory of Romania, by transit color, organized by agreements with the neighboring states.
(2) By way of exception, the entry of foreign citizens and stateless persons belonging to the following categories
to the territory of Romania is allowed: a) they are family members of the Romanian citizens;
b) are family members of the citizens of other Member States of the European Union or of the European Economic Area or of the Swiss Confederation, residing in Romania;
c) are persons who hold a long-stay visa, a residence permit or a document equivalent to the residence permit issued by the Romanian authorities according to the Government Emergency Ordinance no. 194/2002 regarding the regime of foreigners in Romania, republished, with subsequent amendments and completions, or a document equivalent to them issued by the authorities of other states, according to the law of the European Union;
d) are persons traveling in professional interest, evidenced by visa, residence permit or other equivalent document;
e) is diplomatic or consular personnel, personnel of international organizations, military personnel or personnel who can provide humanitarian aid;
f) they are passengers in transit, including those repatriated as a result of granting consular protection;
g) are passengers traveling on imperative grounds (medical or family);
h) are persons who need international protection or for other humanitarian reasons.
(3) The measure shall be applied from March 22, 2020, at 22:00, the time of Romania.
Article 7. -
(1) Persons isolated at home, as a measure to prevent the spread of COVID-19, who leave the place where they were placed, without the approval of the competent authorities, are considered persons with an increased risk of contagiousness and are led by the law enforcement and placed in institutionalized quarantine, under guard.
(2) The quarantined persons, as a measure to prevent the spread of COVID-19, who leave the place where they were placed, without the approval of the competent authorities, are quarantined for a new period of 14 days.
(3) The measures ordered according to paragraphs (1) and (2) do not exempt the persons from the contraventional or criminal liability.
(4) The measures shall be applied from the date of publication of this military ordinance in the Official Gazette of Romania, Part I.
Article 8. -
(1) The authorities of the local public administration have the obligation to identify and keep the records of persons over 65 years of age, without supporters or any other form of assistance, and to ensure their support in order to minimize their exposure outside the houses.
(2) The records shall be updated and reported weekly at the county center / of the Bucharest municipality for coordination and management of the intervention.
(3) The local, county and Bucharest committees for emergency situations identify support modalities for the persons mentioned in paragraph (1).
(4) The measures shall be applied from the date of publication of this military ordinance in the Official Gazette of Romania, Part I.
Article 9. -
(1) The Military Ordinance no.1 / 2020 regarding some emergency measures regarding the agglomerations of persons and the cross-border movement of goods, published in the Official Gazette of Romania, Part I, no.219 of March 18, 2020, shall be completed after as follows:
1. In Article 2, two new paragraphs, paragraphs (2) and (3) are inserted, with the following content:
"(2) Jobs in places of worship may be officiated by church / religious servants, without access to the public, the jobs can be transmitted in the media or online.
(3) Liturgical / religious acts of private character (baptism, weddings, funerals) may be officiated, in which a maximum of 8 persons may participate, as well as the sharing of the sick believers at their domicile ”.
2. After paragraph 2 of Article 4, a new paragraph (3) shall be inserted, with the following content:
"(3) The provisions of paragraphs (1) and (2) shall also apply to drivers of motor vehicles with maximum authorized capacity greater than 2.4t ”.
3. After paragraph 2 of Article 5, a new paragraph, paragraph (3) is inserted, with the following content:
"(3) Other exceptions to the prohibition provided for in paragraph (1) shall be established by order of the Minister of Health. "
(2) The measures shall be applied from the date of publication of this military ordinance in the Official Gazette of Romania, Part I.
Article 10. -
(1) I am entitled to ensure the application and observance of the provisions of the present military ordinance:
a) The Romanian Police, the Romanian Gendarmerie, the local Police, the National Agency for Fiscal Administration, the National Consumer Protection Authority and the leaders of the local public administration authorities, for the measures provided for in art. 1 and 2;
b) Romanian Police, Romanian Gendarmerie, Local Police, for the measures provided in art. 3, 5 and 7;
c) The Romanian Border Police, for the measure provided in art. 6.
(2) Failure to comply with the first emergency measures provided for in art. 1 - 7 shall result in disciplinary, civil, contraventional or criminal liability, in accordance with the provisions of art. 27 of the Emergency Ordinance no. 1/1999, as subsequently amended and supplemented.
(3) The personnel of the institutions referred to in paragraph (1) are authorized to find contraventions and to apply sanctions, in accordance with the provisions of art.29 of the Emergency Ordinance no.1 / 1999, with the subsequent modifications and completions.
Article 11. -
(1) This military ordinance is published in the Official Gazette of Romania, Part I.
(2) The audiovisual media service providers have the obligation to inform the public, by means of regularly broadcast messages, for at least 2 days from the date of publication, about the content of the present military orders.
