The whole decision has been delayed. The purchase of the medium distance DMR (G26) has been cancelled completly. The purchase of new large/heavy helicopters has aswell been cancelled. In the end the chances for the purchase of the HK416 is pretty high since all special units of the Bundeswehr already use it.

Yes, any administrative decision in Germany can be appealed, but the decision to buy from Haenel has not been cancelled, but will be re-evaluated.

But wich patent are they talking about???
This is unclear. According to this article (German) though, Haenel's MK556 is a "slightly modified copy of the HK416". Possible issues are the firing pin block or the gas piston. This wouldn't be surprising since Haenel employs a lot of former H&K staff. In fact their CEO was H&K's quality manager at a time. Further infighting is expected as H&K is highly indebted and needs this order to get back on their feet.

Add to that a political dimension since Haenel is held by a United Arab Emirates company. The production would be "90% Gernan" according to Haenel, but that might not be sufficient for some.
