This is a Hotchkiss H38 being inspected by German soldiers. Other references on the web suggest that the tank was taken out during the campaign in Norway and belonged to the 342th CACC Narvik.
The first picture came with a descripion as follows
The French Hotchkiss No. 40747 from 342 CACC was abandoned on the small beach on the north of Nakvik during the allies offensive on 28 May 1940. The tank was left on the beach for some time and became the subject for photography for germans and local people.
